CoachBot Inc., ("CoachBot", "we," "us," "our," or "Company") understands that you care about how your personal information is used and we take personal privacy seriously. The following Privacy Policy (this "Privacy Policy") describes how we collect, store, and use your personal information. By visiting, accessing, or using the www.coachbotapp.com website, domain name, any mobile applications created by CoachBot, any other content features, our software as a service platform, or application services offered by us in connection therewith (collectively, the "App"), or using any of our services, you acknowledge that you accept the practices and policies outlined herein.

YOUR ACCEPTANCE OF THIS PRIVACY POLICY

By directly or indirectly accessing or using the App, you signify, represent, and warrant that you are older than 19 years of age, that at all times shall have the necessary power, capacity and authority to enter into, abide by, comply with, and perform your obligations under this Privacy Policy, and you consent to our collection, storage, use, and disclosure of your information as described in this Privacy Policy. The provisions contained in this Privacy Policy supersede all previous notices and statements regarding our privacy practices with respect to the App. If you do not agree to every provision of this Privacy Policy, you may not access or use the App.

We may amend this Privacy Policy from time to time in our sole discretion without notice. We will post an amended version and ensure it is available on the App. You acknowledge and agree that your continued use of the App, following any amendment of this Privacy Policy, shall signify your assent to, and acceptance of, such amended terms and conditions. If you do not agree to any term or condition of this Privacy Policy, or any subsequently amended term or condition thereof, you cannot use the App.

WHAT PERSONAL INFORMATION DO WE COLLECT?

When you use the App, we may collect information that identifies you ("Personal Information"), and we may also collect information that does not identify you ("Anonymous Information"). When Anonymous Information is, directly or indirectly, associated or combined with Personal Information, such Anonymous Information will be considered Personal Information for purposes of this Privacy Policy. In addition, to the extent Internet Protocol ("IP") addresses or similar identifiers or information are considered personally identifiable information by applicable law, we will treat such identifiers and information as Personal Information under this Privacy Policy.

Information You Provide Us

In general, you may visit the App without telling us who you are or sharing any Personal Information with us. When you register for an account for the App (an "Account"), use other aspects of the App, or communicate with us for customer service or technical support for the App, we may ask you to provide certain Personal Information, such as:

  • Your name;
  • Your email address;
  • Personal characteristics which may include:
    • Date of birth and gender;
    • Age;
    • Picture and physical description;
    • Social media accounts and affiliations;
    • Contact info such as cell, work and home phone numbers;
  • Characteristics related to physical fitness and exercise, which may include:
    • Height;
    • Weight;
    • Body fat percentage;
    • Heart rate;
    • Fitness preferences;
    • Injuries and other physical limitations;
    • Other information necessary for sport and fitness analysis;
  • Information you provide for payment purposes, which may include:
    • Credit card information
    • Checking account number and routing number;
    • Other payment account or payment method information.

You may decline to provide Personal Information to us, but, if you do so, certain features of the App may not be available to you or the performance of certain features of the App may be limited or not work at all. You may also voluntarily provide Personal Information to us, such as your background, training and fitness goals, and other biographical information, which may or may not be associated with your Account.

Other Anonymous Information that we may collect, includes, but not limited to:

  • Conversation history;
  • Workout routine;
  • Workout completion information.

Information Collected From Devices

When you access the App using a computer or mobile device, including, without limitation, a desktop computer, laptop, mobile phone, tablet, or other consumer electronic device (each, a "Device"), we may collect information from your Device, such as your Device type and manufacturer, your mobile carrier, your device software version, your Device identifiers, your mobile phone number, your IP address, your browser type, your network connection type, information about the web page that referred you to the App or that you visited prior to the App, and your behavior and activity on the App. Your behavior and activity on the App may include, but is not limited to, the amount of time you spend using the App and your login and logout times.

HOW WE USE AND SHARE INFORMATION

We may use or share Personal Information for the purposes described elsewhere in this Privacy Policy and internally for our general commercial purposes, including, among other things, to:

  • create and activate your Account;
  • provide customer and technical support for the App;
  • analyze, improve, and customize the App;
  • make the App available to you and for other users of the App;
  • improve the quality of the App;
  • send you announcements, notifications, and other information about the App;
  • detect, prevent, and investigate actual or suspected fraud, hacking, infringement, or other misconduct involving the App;
  • collect fees and other amounts owed in connection with the App;
  • install software on one or more of your electronic devices;
  • protect the rights, property, personal safety of yourself, us, our agents, our users, and the public;
  • complete a purchase, transfer, or sale of services or assets (e.g., in the event that substantially all of our assets are acquired by another party, your Personal Information may be one of the assets) or in the event of bankruptcy;
  • enforce this Privacy Policy, or any other agreement entered into between yourself and us; and
  • comply with any applicable laws, or as authorized by any applicable laws.

INFORMATION YOU SHARE SOCIALLY

The App may allow you to connect and share your actions, comments, content, and information publicly or with friends, mentors, mentees, and other App users. We are not responsible for maintaining the confidentiality of any information you share publicly or privately. In addition, the App may allow you to connect with us and share on third-party websites, applications, and services. Please be mindful of your personal privacy needs and the privacy needs of others, as you choose whom to connect with and what to share and make public. We cannot control the privacy or security of information you choose to make public or share with others. We also do not control the privacy practices of third parties. Please contact those websites and services directly if you want to learn about their privacy practices.

DATA RETENTION

Because our users tend to use our App over varying periods of time, we may retain your information, including Personal Information, for continued service and convenience purposes until you advise us not to do so. We may retain your Personal Information and other information as we deem necessary in order to comply with applicable laws, to resolve disputes, to maintain accurate records, and to prevent fraud and abuse.

ACCESS TO YOUR PERSONAL INFORMATION

Subject to applicable law, which might, from time to time, oblige us to store your Personal Information for a certain period of time, we will respect your wishes to correct inaccurate information. Otherwise, we will retain Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by applicable law. You may request to access Personal Information or change any inaccurate Personal Information stored on the App at any time through the feedback option in chat in the App.

PROTECTING CHILDREN AND MINOR DATA

We do not knowingly collect Personal Information from anyone under the age of 19. The App is not directed, or intended to be attractive, to anyone under the age of 19. If you are under the age of 19, please do not use any aspect of the App.

GOVERNANCE

This Privacy Policy will be governed by the laws of the Province of British Columbia and the laws of Canada applicable therein, excluding any conflict of rules that would apply to another body of law. You hereby agree to submit the exclusive jurisdiction of the courts in Vancouver, British Columbia with respect to any claim, proceeding, or action relating to or otherwise arising out of this Privacy Policy or your access to or use the App, howsoever arising, provided that we may seek and obtain injunctive relief (or an equivalent type of urgent legal relief) in any jurisdiction.
